Introduction to Hillcrest Tennis Camp Terms & Conditions
Welcome to Hillcrest Tennis Camp ("HTC," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website located at www.hillcresttenniscamp.com (the "Site") and all related services, programs, and activities offered by Hillcrest Tennis Camp.
Hillcrest Tennis Camp is a trade name operated by Wimbledon Investments Inc., a corporation registered in the Province of Ontario, Canada. All references to "Hillcrest Tennis Camp," "HTC," "we," "us," or "our" in these Terms refer to Wimbledon Investments Inc. and its operating trade name Hillcrest Tennis Camp, located in North York, Ontario, Canada.
By accessing our Site, registering for any program, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.
2. Definitions
- "Participant" refers to any individual enrolled in HTC programs, including minors enrolled by their parent or legal guardian.
- "Parent/Guardian" refers to the parent or legal guardian of a minor Participant.
- "Programs" refers to all tennis lessons, camps, clinics, and related activities offered by HTC.
- "Registration" refers to the process of enrolling in any HTC Program.
3. Eligibility and Registration
3.1 Age Requirements
Our junior programs accept participants aged 4-18 years. Adult programs are available for participants 18 years and older. Parent or legal guardian consent is required for all participants under 18 years of age.
3.2 Membership Requirement
All participants must hold a valid Hillcrest Tennis Club membership to participate in any HTC programs. Membership must be obtained through Hillcrest Tennis Club prior to program enrollment.
3.3 Registration Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information as necessary. We reserve the right to suspend or terminate accounts containing inaccurate or incomplete information.
4. Payment Terms
4.1 Fees
All program fees are listed on our Site and include applicable HST (Harmonized Sales Tax) as required under Ontario law. Prices are subject to change without notice, though registered participants will not be affected by price changes for their current enrollment period.
4.2 Payment Methods
We accept payment through our secure online payment system. Full payment is required at the time of registration unless otherwise specified.
4.3 Refund Policy
Refunds: Refund requests must be submitted in writing to info@hillcresttenniscamp.com. Refunds may be issued at our sole discretion, subject to a processing fee. No refunds will be provided for missed sessions due to participant absence. Weather-related cancellations will be rescheduled, not refunded.
5. Assumption of Risk and Liability Waiver
Important: Please read this section carefully. By registering for any HTC program, you acknowledge and accept the following terms.
5.1 Inherent Risks
Tennis and related physical activities involve inherent risks of injury, including but not limited to sprains, strains, fractures, heat-related illness, and other physical injuries. By participating in HTC programs, you voluntarily assume all such risks.
5.2 Liability Waiver
To the fullest extent permitted by Ontario law, you agree to release, waive, discharge, and hold harmless Wimbledon Investments Inc. (operating as Hillcrest Tennis Camp), Hillcrest Tennis Club, their owners, directors, officers, employees, coaches, volunteers, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury that may be sustained during participation in HTC programs.
5.3 Medical Emergencies
In the event of a medical emergency, HTC staff are authorized to seek emergency medical treatment for participants. Parents/Guardians are responsible for all associated medical costs. You agree to disclose any relevant medical conditions, allergies, or physical limitations during registration.
5.4 Limitation of Liability
To the maximum extent permitted by applicable Ontario law, HTC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or the nature of the claim.
6. Code of Conduct
All participants, parents, and guardians are expected to:
- Treat all coaches, staff, and fellow participants with respect and courtesy
- Follow all instructions provided by HTC coaches and staff
- Refrain from using abusive, threatening, or inappropriate language or behavior
- Respect HTC property and the property of Hillcrest Tennis Club
- Arrive on time for scheduled sessions
- Notify HTC in advance of any absences
HTC reserves the right to dismiss any participant who violates this Code of Conduct without refund.
7. Weather and Cancellations
HTC programs are conducted on outdoor courts and are subject to weather conditions. In the event of inclement weather:
- Sessions may be cancelled or modified at the discretion of HTC staff
- Make-up sessions will be scheduled when possible
- No refunds will be issued for weather-related cancellations
- During summer camp, indoor activities may be provided as an alternative when feasible
8. Photography and Media Release
By registering for HTC programs, you grant HTC permission to photograph, video record, and use the likeness of participants for promotional, marketing, and educational purposes, including but not limited to use on our website, social media, and printed materials.
If you do not consent to media use, you must notify us in writing at the time of registration.
9. Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, images, and software, is the property of Hillcrest Tennis Camp or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.
10. Privacy and Personal Information
We collect and use personal information in accordance with applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA). Information collected during registration is used solely for program administration, communication, and improving our services.
We do not sell or share personal information with third parties except as required to deliver our services or as required by law.
11. Facility Rules
- Peanut-Free Facility: Hillcrest Tennis Club is a peanut-free facility. No peanut or peanut-containing products are permitted.
- Appropriate tennis attire and footwear must be worn at all times
- Participants should bring water, sunscreen, and appropriate sun protection
- Personal belongings are the responsibility of participants; HTC is not responsible for lost or stolen items
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
13. Indemnification
You agree to indemnify, defend, and hold harmless Wimbledon Investments Inc. (operating as Hillcrest Tennis Camp) and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your use of our services.
14. Modifications to Terms
HTC reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our Site. Your continued use of our Site or services following any changes constitutes acceptance of the modified Terms.
We encourage you to review these Terms periodically for updates.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
16. Accessibility Commitment
Hillcrest Tennis Camp is committed to providing an accessible website and services for all users, including individuals with visual, hearing, cognitive, and motor impairments.
